It is very important that you read these Terms and Conditions carefully. For reference, the following Terms and Conditions refer to the Title Standard which covers both standard09.co.uk and standard09.com. Standard may modify these Terms and Conditions from time to time without prior notice and such modification shall be effective upon posting on the Site. You agree to be bound to any changes to these Terms and Conditions when you use the Site after any such modification is posted. It is important that you review these Terms and conditions regularly to ensure you are updated as to any changes made. These Terms and Conditions constitute the entire agreement regarding your use of the Site and the services it offers and supersede any such prior terms. Your use of the Service and the Site is at your own risk. Neither Standard nor any of its Agents or Representatives shall be liable to you or anyone else for any loss or injury, or any direct, indirect incidental, special, consequential, punitive or similar damages arising out of your access or use of, or your inability to access or use, the Service and the Site and the information available on the Service and the Site or arising out of any action taken in response to or as a result of any information available on the Service or the Site.

By continuing, you hereby waive any rights and all claims against Standard, Agents and Representatives arising out of the use of the Service and the Site and the information available thereon and you accept, without limitation, the following Terms and Conditions.

1. Standard is not intended for users under the age of 18. If you are 17 years or younger do not submit a portfolio or any personal information.

2. Standard is a portfolio web site and community for models and established model photographers. Standard provides a hosting service for person-to-person display, marketing, and communication on an individual and professional level between models, photographers, make-up artists and agencies plus selected associated service providers. Standard does not own or claim to own any personal portfolio content or images uploaded by individual users for individual promotion and presentation. It is the responsibility of the user to abide by this agreement and site guidelines.

3. You understand and agree that the Site is provided "As-Is" and that Standard assume no responsibility for your ability to (or any costs or fees associated with your ability to) obtain access to the Site. Nor do Standard assume any liability for the failure to store or maintain any user communications or personal settings.

THE SERVICE AND THE SITE ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPOSED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT. NEITHER STANDARD09.CO.UK, NOR ITS AGENTS AND REPRESENTATIVES ENDORSE OR ARE RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE OR STATEMENT ON THE SERVICE OR THE SITE.

4. Standard users may have profiles either at a "basic" level (free) or may sign up for a paid membership. Standard charges membership fees for each paid membership account. Membership will last for one calendar year and Standard will remind Members one month before expiry to give you the opportunity to renew Membership without any loss of service. Standard reserves the right to increase membership fees or to institute new fees at any time, upon reasonable notice posted in advance on this Website. The act of paying fees does not exclude the member from these terms or the site's rules, which must be obeyed by all members.

5. Standard has a zero tolerance policy regarding the posting of sexually explicit images to its web pages. Male / Female full frontal nudity is not acceptable. Sexually explicit images of any nature are not permitted on this site. Sexually explicit images include but are not limited to obvious states of sexual arousal (erections), images of sexual intercourse, or overt sexual positions (such as noticeably visible or spread genitalia). Failure to adhere to this restriction will result in the removal of the images, and the disablement of that member's portfolio.

6. The Service and the Site include bulletin boards and chat rooms which allow you and other users to post information, provide feedback to Standard and its affiliates, and interact in real-time. You agree to not post information or correspondence that is not of a professional nature or which contravenes UK and/or International Trademark or copyright laws and restrictions in any way. In addition, you agree not to post or transmit any unlawful, fake, fraudulent, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offence, violate the rights of others, or otherwise violate any applicable local, national or international law. You will be responsible for, and indemnify Standard, its affiliates, agents and representatives against, any claim arising from any material that you post or transmit.

7. Although Standard and its moderator / administrator may from time to time monitor or review discussions, chats, postings, transmissions and bulletin boards on the Site, neither Standard nor its affiliates is under any obligation to do so. Standard reserves the right to change or modify portfolio information or message board postings as needed and without notice. You acknowledge that Standard and its moderator / administrator do not control the information available on the bulletin boards and chat rooms and that any opinions, advice, statements, services, offers or other information or content presented or disseminated on any bulletin board or in any chat room are those of their respective authors who are solely liable for their content.

8. Standard and its moderator / administrator reserve the right, at their sole discretion, to edit, refuse to post, or remove any material, links, email addresses, images, and content submitted to, or posted on the chat rooms, bulletin boards, or portfolios. Standard reserve the right, in their sole discretion, to deny access to the e-mail systems provided for general community use. Standard has guidelines regarding posting of appropriate images, email addresses, content, and links. Premium members may, as a privilege and at the discretion of Standard, be allowed to upload images to a showcase Gallery on strict condition that they comply with upload instructions and on the understanding that non-compliance may result in a Gallery Ban.

10. Any communication or material you post or transmit to the Service and/or the Sites is, and will be treated as, non-confidential and non-proprietary. You assume full responsibility for anything you post or transmit, and you grant Standard and its affiliates the right to edit, copy, publish and distribute any information or content you post or transmit for any purpose.

11. Standard and its moderator / administrator do not review or monitor any web sites linked to the Service or from personal portfolios on this site. When clicking links to personal pages from Standard all users of the system acknowledge that Standard is not responsible for the accuracy or content of those links. You agree to not post URL's and other web links in any form, into your personal home page section, or the main portfolio page as links or text, that lead to Adult Sites or Pay Sites. Standard reserves the right to remove from its sites any references or portfolios containing Adult Sites or Pay Sites without notice. Additionally certain links to sites, as determined from time to time by Standard, or the use of links and web addresses, or the use of html formatting and scripting in certain portfolio types as determined by Standard, may not be permitted within the portfolio or as an acceptable use of the personal home page link or as portfolio content.

12. Standard is under no obligation to provide exposure to competing sites through links or other methods in portfolio and may remove those at its discretion, and without notice. 'Vote for me' canvassing and 'competition' promotion are not allowed. Telephone numbers and e-mail addresses may not be displayed in forum posts or profile notes. The Standard referral system is intended for work related offers and general enquiries related to or leading to work or further discovery. Promotion of services and goods is not an appropriate use of the referral system. Standard permits one main free member portfolio per person.

13. The Promotion and Recruitment of Escorts, Escort Services, Personal Companions, (etc.) are contrary to the purposes of Standard, and will not be tolerated in any fashion. Soliciting for, recruiting, or offering the services of escorts on this site is strictly prohibited. Portfolios that are used for the solicitation or promotion of escort services in ANY way will be immediately disabled with no refund. This includes (but is not limited to) use of the referral system, hyperlinks to external sites promoting escorts, URLs (web addresses) promoting escorts and any other activity that the administrator / moderator of Standard deems as solicitations, promotions, or offers.

14. Standard does not support bandwidth theft, the linking of images from Standard to other sites, or the misuse of links from other sites to Standard. Anyone found linking images from Standard to other sites, copying content from Standard, or inappropriately linking to Standard (to increase their views - through use of hidden frames, or using programs to artificially raise page views etc.) will result in permanent removal from Standard without notification.

15. As a member of Standard - you will be contacted by other system members seeking to work with you, as well as occasional emails from Standard. As new features or member programs and promotions are developed and launched you will be informed via the postings to the site and also by email.

16. Standard may use any of the images a member submits for the top banner on the homepage provided a link is placed to that member's profile.

17. Members are not permitted to promote or advertise in any way activities that involve sexual contact between photographers and models as part of shoots (often termed "point of view" or "gonzo"). In addition Members are also not permitted to promote or advertise for work that includes sexual contact between male and female; whether clothed or un-clothed. Members who engage in these styles of work or activities, through the forums or the internal messaging system, will have their memberships cancelled.

18. All Members of the Site shall receive a password and an account. Members are entirely responsible for any and all activities, which occur under their account whether authorized or not. Member agrees to notify Standard of any unauthorized use of a Member's account or any other breach of security known or should be known to the Member. Member's right to use the Site Service is personal to the Member. Member agrees not to resell or make any commercial use of the Site Service without the express written consent of Standard.

19. It is the responsibility of the user to review and abide by the rules of any third party payment systems which Standard uses to collect subscriptions.

20. Standard does not provide refunds for any membership fees. Downgrades to a less expensive membership or cancellation of any membership will not result in any refund or credit of fees already paid. Membership fees are charged up-front and no refunds or credits will be given upon cancellation or downgrades. The downgrade of a membership will go into effect at the end of your current billing cycle.

21. The material on this Site is protected by copyright, trademark, and other applicable laws. Much of the content of this site is owned by individual members of the community and therefore you may NOT modify, copy, reproduce, republish, upload, post, transmit, publicly display, prepare derivative works based on, or distribute in any way any material belonging to the Site or its members, including but not limited to text, photos, audio, video, code and software. During your visit and in the course of your normal use of the site, you may download or utilize material displayed on the Site for non-commercial, personal use only (provided that you also retain all copyright and other proprietary notices contained on the materials). Standard neither warrant nor represent that your use of materials displayed on the Site will not infringe rights of third parties not owned by us or affiliated with this Site. Standard will not be responsible for any misleading, false or otherwise injurious information and advice communicated on the Site or for any results obtained from the use of such information or advice. Standard will not be liable for any loss or damage suffered by a user through the user's reliance on information and advice gained on the Site.

22. The Site may provide you and other users an opportunity to submit, post, display, transmit and/or exchange information, ideas, opinions, photographs, images, video, creative works or other information, messages, transmissions or material to us, the Site or others ("Post" or "Postings"). Postings do not reflect views of Standard and Standard do not have any obligation to monitor, edit, or review any Postings on the Site. standard09.co.uk assume NO responsibility or liability arising from the content of any such Postings or for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such Postings on the Site. You are strictly prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Without limiting the foregoing, the following behaviors are strictly prohibited:

- Racially, ethnically or otherwise, objectionable language
- Strong, vulgar, obscene or otherwise harmful language
- Harassing, intimidating, stalking or threatening other members
- Libelous, defamatory or otherwise tortuous language
- Online vandalism
- Impersonation of another person
- Posting, distributing, transmitting or promoting illegal content
- Invasion of another's privacy
- Actions that are hurtful to minors
- Posting, providing, transmitting or otherwise making available any materials or information, infringing on the rights of a third party
- Posting, providing, transmitting or otherwise making available any junk mail or spam
- Posting, uploading, emailing or otherwise transmitting any material that contains any malicious computer code, or reverse engineering or hacking any materials on the Site.

Standard will fully cooperate with any law enforcement authorities or court order requesting or directing the Site to disclose the identity of anyone posting any such information or materials.

23. You represent and warrant that you own the content posted by you on or through the Site or otherwise have the right to grant the license and that the Posting of your content does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. If at any point you feel that others may be infringing on these rights, please contact Standard.

24. When you post content to the Site, you authorize and direct Standard to make such copies thereof as deemed necessary in order to facilitate the posting and storage of the content on the Site. Through the action of posting such content (images, text, video, etc) you are also granting the Site a non-exclusive worldwide license to use, copy, publicly display, publicly perform, reformat, translate such User content (in whole or in part) and distribute such content in connection with operation of the Site. This limited license does not grant Standard the right to sell or otherwise distribute your Content outside of the Standard Services without the express permission of the rights holder(s).

25. You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content. This Site does not assert any ownership over your User Content; rather, as between Standard and you, subject to the rights granted to us in these Terms, you retain full ownership of all of your User Content and any intellectual property rights or other proprietary rights associated with your User Content.

26. Any use of materials on the website, including reproduction, modification, distribution, or replication, any form of data extraction or data mining, or other commercial exploitation of any kind, without prior written permission of an authorized officer of Standard is strictly prohibited. Users agree that they will not use any robot, spider, or other automatic device, or manual process to monitor or copy Standard web pages or the content contained therein without prior written permission of an authorized officer of Standard.

27. Standard's trademarks may not be used in connection with any product or service that is not provided by Standard, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Standard.

28. The Site may provide links to other websites or resources that we have no control over and you acknowledge and agree that we are not responsible for the availability of such external sites and resources. Standard do not endorse and are not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Standard shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use or reliance on any such content, goods or services available on or through any such site or resource.

29. You should be aware that if you voluntarily disclose personal information (e.g., user name, email address) on a bulletin board or in a chat room, that information can be collected and used by others and may result in unsolicited messages from other parties, and shall therefore be the sole responsibility and liability of the poster. Note that once the search engines have cached a page it may remain on their servers for a considerable period of time.

30. You agree to indemnify and hold Standard, and our affiliates, directors, officers, agents, vendors or other partners, employees and moderators harmless from any claim or demand, including legal fees, made by any third party due to or arising out of any material or information posted, provided, transmitted or otherwise made available by you on the Site or through the Site's services, or by your violation of these Terms and Conditions, or by your violation of the rights of another.

31. Standard's failure to exercise or enforce any right or provision of these Terms and Conditions shall not operate as a waiver of such right or provision. If any provision of these Terms and Conditions is unlawful, void or unenforceable, that provision is deemed severable and does not affect the validity and enforceability of any remaining provisions.

32. You expressly agree not to take any action that imposes, or may impose, in the discretion of Standard, an unreasonable or disproportionate burden on the site infrastructure and "frame," "mirror" or otherwise incorporate any part of this Site into any other website without prior written permission from Standard.

33. This User Agreement and any disputes arising out of or related to the Service and the Site shall be governed by, and construed and enforced in accordance with, the laws of the United Kingdom. By your usage of, or your posting to, this site constitutes your agreement to, but not limited to, the current conditions listed in this agreement.

34. Violation of any of the above Terms and Conditions will cause immediate termination of your membership without notification.

35. Decisions made by the Moderator and Administrator are final.
